An Eritrea-born man is expected to appear in Melbourne Magistrates’ Court for allegedly failing to comply with a curfew.

The AFP arrested and charged the man, 36, late on Friday night after he was located in inner-west Melbourne.

It will be alleged the man breached the conditions of his Commonwealth visa earlier on Friday by failing to observe his residential curfew obligations.

The man has been charged with one count of failing to comply with a curfew condition, contrary to section 76C(1) of the Migration Act 1958.

The offence carries a maximum penalty of five years in prison and a $93,900 fine.
